Mediation is:
Impartial, Neutral, Balanced, and Safe
The mediator is neutral and has a responsibility to assist each mediating party. He/She does not favor the interests of one party over another, nor will the mediator favor a particular result in the mediation. The mediator's role is to ensure that parties reach agreements in a voluntary and informed manner, not as a result of coercion or intimidation.
Voluntary
You, the other party, or the mediator can end the process at any time for any reason. Mediation is an entirely voluntary process.
Collaborative
You are encouraged to work together with the guidance of the mediator to resolve your dispute(s) by reaching a creative agreement customized to your situation.
Confidential
Mediation is a confidential process to the extent both parties desire. Mediation discussions and all materials developed for mediation are not admissible in any subsequent court or contested proceedings, except for a finalized and signed agreement for enforcement purposes.
Empowering
You have complete decision-making power. Each party has equal power to negotiate terms. Nothing can be imposed on you.
Informed
The mediation process offers an opportunity to obtain and incorporate legal, tax, financial, and other expert information and advice. Individual or mutual experts can be retained. The parties always retain decision-making power. We strongly encourage parties to obtain legal counsel and to have any mediated agreement involving legal issues reviewed by independent legal counsel prior to signing. Whether legal advice is sought is, ultimately, a decision of each participant.
